1. The service
Kingston Insights Smart Notebook is a personal notebook application operated by Kingston Insights ("we", "us") at kingstonmark.com. It lets you capture notes and tasks in the app and, optionally, by text message ("Text your notebook"). By using the service you agree to these terms between you and Kingston Insights.
2. SMS program description
When you opt in to the SMS feature, you can send text messages to your notebook's dedicated phone number to save them as notes, and you may receive: (a) a one-time verification code when you link your phone number, (b) brief confirmations when a texted note is saved, and (c) if you keep reminders enabled, at most one daily reminder about your high-priority tasks. All messages relate solely to your own account. We do not send marketing or promotional messages, and we do not message anyone on behalf of third parties.
3. Opt-in
The SMS feature is strictly opt-in. You enroll by entering your mobile number in the app's Settings and confirming a verification code sent to that number. No messages are sent to you unless you complete this verification yourself.
4. Message frequency
Message frequency varies based on your use of the service. Reminder messages are limited to at most one per day. Confirmation messages correspond to notes you choose to send.
5. Fees
Message and data rates may apply according to your mobile carrier plan. Kingston Insights Smart Notebook does not charge for SMS separately. Carriers are not liable for delayed or undelivered messages.
6. Opt-out and help
- Reply STOP to any message to stop receiving reminder texts. You can also turn reminders off, or unlink your phone number entirely, in the app's Settings.
- Reply START to resume reminders after opting out.
- Reply HELP for assistance, or use the app's Settings page.
7. Privacy
Your use of the SMS feature is covered by our Privacy Policy. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
8. Acceptable use
You agree not to use the service for unlawful purposes, to send content you do not have the right to store, or to attempt to access another person's notebook. We may suspend accounts that abuse the service or the SMS feature.
9. Disclaimers
The service is provided "as is" without warranties of any kind. SMS delivery depends on mobile carriers and may be delayed or fail; do not rely on the service for emergency or time-critical communications.
10. Changes
We may update these terms from time to time. Material changes will be reflected on this page with an updated date. Continued use of the service after changes take effect constitutes acceptance.
